1. COVENANT: In signing this agreement, (hereinafter referred to as “Client”) attests that he/she has reviewed Vanie Poyey’s (hereinafter referred to as “Photographer”) website and/or her portfolio in person, and is hiring, and agrees to pay Photographer, based on her style of photography as represented by her body of work.

2. RE-SHOOTS: Photographer’s work is technically guaranteed. This means everything within the Photographer’s control is guaranteed. Re-shoots will only be granted due to technical issues (including, but not limited to: bad data cards, malfunctioning equipment and lab errors in processing.) Re-shoots will not be granted based on subjective preferences due to the style of the final products. Wardrobe decisions by Client do not constitute grounds for a re-shoot (see item 3.) Missing “looks” or wrong “looks” decided upon by Client but later disagreed upon by Client’s representatives do not constitute grounds for a re-shoot (see item 4.) Dissatisfaction with makeup does not constitute grounds for a re-shoot (see item 5.) Client previews every image throughout the session and Photographer does not proceed until Client is satisfied with what he/she sees. (If anything is not working for you including wardrobe, makeup, backgrounds, lighting, squinting issues etc. the time to speak up is during the shoot, not after. We simply cannot read your mind and do everything possible to make you comfortable to speak up.) Without exception, there are no re-shoots and no refunds for non-technical reasons.

3. WARDROBE: Wardrobe is client’s responsibility. Wardrobe suggestions are emailed shortly after booking a session, stressing the importance of a broad range of clothes. The photographer is not responsible for unsatisfactory results due to client’s lack of preparation. Furthermore, the final wardrobe chosen on the day of shooting will be made with the client’s full participation and agreement. Wardrobe decisions by client as agreed with Photographer will not constitute grounds for a re-shoot.

4. MARKETING STRATEGY, REPRESENTATIVE’S APPROVAL: Marketing strategy and all around basic attitude is the Client’s responsibility. Possible looks for showcasing various markets are discussed during the consultation and then finalized with the client’s full participation and agreement on the day of the shoot. Representative’s disagreement with client’s choices of looks as conveyed to and or agreed with photographer, does not constitute grounds for a re-shoot.

5. MAKEUP: Client approves all makeup BEFORE the photo shoot begins. Dissatisfaction with makeup after a shoot is not grounds for a re-shoot. Cancellation of a makeup artist the day of requires a partial compensation of 50%. A “No show” requires full compensation to the makeup artist booked for the day. Please note, you may not bring in a makeup artist with you. We only work with our own trained team so if you require a makeup artist during your session, you'll need to ask us to book one of our makeup artists.

6. RESERVATION FEE, CANCELLATION POLICY: Unless you've paid in full through an industry affiliate link, a non-refundable reservation fee is required to secure a session and applies towards the cost of your photo session for up to 90 days. If a session is rescheduled for more than 90 days from the original date, the initial reservation fee is forfeited (if paid in full, the same fee is deducted from your credit) and a new reservation fee is required (if paid in full, the same amount is required in credit). To reschedule a session, a five business day notice must be given or the reservation fee will be forfeited (or deducted from your credit). To reschedule a session with five days or more notice, an additional non-refundable reservation fee (or the same amount in credit) is required to hold the new date. Both fees apply towards the session. In the event of a complete cancellation, the entire reservation fee(s) will be forfeited.

7. OVERTIME CHARGES: Based on Photographer’s extensive experience, a typical four outfit session lasts 2.5 to 3 hours including time for makeup and wardrobe selection. Client understands that if more time is needed than the allotted time for the package being purchased, he or she will be charged an additional fee of $150 per hour. We will never rush you or make you feel as though you are taking too long. Our goal is to ensure you are happy with the results you see and take as much time as you need for a positive experience. Inefficient use of time includes excessively fussing over hair, indecision on wardrobe and taking too long between changes. It is Client’s responsibility to be aware of the time.

8. RETOUCHED HI-RESOLUTION IMAGES: Except for the unlimited look package, high-resolution images for retouching or printing are not included and will need to be purchased. Retouched images are custom color balanced, and profiled for press. There is a small unobtrusive photo credit placed on the bottom corner of the 8x10, please respect the artist credit.

9. IMAGE AND VIDEO DELIVERY: We do not deliver every image or video captured during your session; the determination of the images and takes delivered is at our discretion (via our best judgment) and based on the number of outfits as outlined in the package purchased. Images not delivered are not retained and are deleted permanently.

10. DISCLAIMER: Client understands that web gallery images and Low-Rez downloads, are not retouched. Low-Rez images are used online and on casting sites as well as to print 4x6 proofs if needed. Image brightness (or lack of it) on a particular monitor does not mean image will appear the same way on another monitor. If need be, image brightness can be adjusted by us. Machine printed 4x6 proofs do not represent the final custom color corrected and retouched 8x10.

11. COPYRIGHT NOTICE AND LICENSE: Client agrees that under copyright laws, except as otherwise specifically provided herein, all photographs remain the property of Photographer, and all rights therein are reserved. Unless otherwise provided herein, any grant of rights is limited to use by client for personal promotional purposes only including but not limited to auditions, casting sites, social media, theater productions etc. No third party commercial use is granted, (e.g. by Warner Brothers to promote a WB movie) including, but not limited to, print, publication, editorial, direct mail marketing, retail displays, packaging, magazine, periodicals, newspaper and billboard advertising, electronic media, and the Internet.

Model Release and Consent Agreement:

We are proud to share what we create together with the online community but posting your image to promote our work is legally considered published advertising and retouching or cropping your image is considered an alteration. Don’t worry, this only gives us permission and does not grant third party rights.

For valuable consideration received, I grant to Vanie Poyey Photography and their legal representatives and assignees, the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without my inspection or approval. I hereby release Photographer and his/her legal representatives and assigns from all claims and liability relating to said photographs.
